Terms of Service

These Terms govern your membership and use of the BNW app and gym, operated by Barbells & Weights Fitness Gym at Magsaysay St., Barangay Poblacion, Cortes, Bohol. By creating an account or using our facilities, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old, or have the consent and supervision of a parent or guardian, to hold a membership.

2. Your account

Provide accurate information and keep it up to date. Your account and login credentials are personal to you — keep them secure and do not share them. One account per person. You are responsible for activity under your account.

3. Membership

• Memberships run for the plan’s duration and expire on the date shown in the app (computed in Philippine time). A membership is active only once payment is confirmed.
• Memberships are non-transferable. They are tied to you as an individual and may not be sold, shared, assigned, or used by anyone else.
• Your entry QR code is personal. Sharing it, or attempting to let another person enter on your membership, may result in suspension or termination.

4. Entry and conduct

Entry is granted by scanning your time-limited QR code at the door, or by staff at the counter. You agree to follow gym rules, staff instructions, and posted safety guidelines. We may refuse or revoke entry for safety reasons or for breach of these Terms.

5. Payments and fees

• All prices are in Philippine Pesos (PHP).
• For online payments, the payment provider’s processing fee is added at checkout and paid by you, on top of the plan price. Cash and bank-transfer payments are recorded at the counter.
• It is your responsibility to renew before expiry to keep uninterrupted access.

6. No refunds

All payments are final and non-refundable. We do not provide refunds, credits, or transfers for unused time, missed visits, change of mind, or early cancellation, except where a refund is required by applicable law. Membership fees are not pro-rated.

7. Suspension and termination

We may suspend or terminate a membership for breach of these Terms, misuse of the facility or app, abusive behaviour, or non-payment. Where a membership is terminated for cause, no refund is due.

8. Health and safety

You should consult a physician before beginning any exercise program. You use the gym, equipment, and facilities at your own risk and are responsible for exercising within your own physical limits. Please inform staff of any condition that may affect your safety.

9. Limitation of liability

To the fullest extent permitted by law, BNW and its operators are not liable for injury, loss, or damage to persons or property arising from use of the gym or app, except where caused by our gross negligence or wilful misconduct, or where liability cannot be excluded by law.

10. Changes

We may update these Terms, our plans, prices, and services from time to time. Changes take effect when posted here. Continued use of the app or gym after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall be brought before the courts with jurisdiction over Cortes, Bohol.
